Terms and Conditions
These terms govern use of the BlueX Digital LLC website and public website tools. Paid services are governed by a separate written agreement.
Website use and scope
Please review these terms before using bluexdigital.com. By using the website, you agree to these terms to the extent they are enforceable under applicable law. If you do not agree, discontinue use. You must have authority to submit information or act for an organization.
These website terms do not replace a signed proposal, statement of work, confidentiality agreement or other client agreement. If there is a conflict about an engagement, the applicable signed agreement controls.
Inquiries and engagements
Submitting a form, requesting a scan or contacting us does not create a client relationship, reserve availability or commit either party to a project. Scope, fees, payment, deliverables, timelines, ownership and support obligations must be agreed separately in writing.
Website pricing, examples and descriptions are informational and are not a binding quotation. We may decline a request or require additional information before accepting an engagement. Do not assume an inquiry is being monitored for urgent deadlines.
Acceptable use
Use the website lawfully. Do not attempt unauthorized access, interfere with availability, bypass security or rate limits, submit malicious code, impersonate others or use our tools to harm another person or organization.
Use the Website X Ray tool only for public pages you own or have authority to assess. Do not submit private systems, credentials or addresses containing access tokens. We may restrict access to protect the website or address misuse.
Information you submit
You are responsible for the accuracy of submitted information and for having the rights and permissions needed to provide it. You retain your rights in your submissions and permit us to use them as reasonably necessary to evaluate and respond to your request or perform an agreed service.
Public forms are not a secure evidence transfer channel. Do not submit privileged material, passwords, seed phrases or private keys. Submission alone does not establish a separate confidentiality agreement or any legal privilege. Our handling of personal information is described in the Privacy Policy.
Intellectual property
Website content, design, original code and BlueX branding are owned by or licensed to BlueX Digital LLC, except where identified otherwise. You may view the website for its intended purposes. Other use of protected material requires permission or a right provided by applicable law.
Client names, trademarks, screenshots and linked content belong to their respective owners. Portfolio presentation does not grant rights in a client's materials or imply endorsement beyond the described project. Ownership and licensing of paid deliverables are addressed in the relevant client agreement.
Tools, external services and results
Website X Ray results are automated observations about a limited public page at a particular time, not a comprehensive security, accessibility, legal, performance or search audit. Results may be incomplete or inaccurate and require independent review.
External links are provided for convenience. We do not control external websites, their availability or their policies. Search placement, AI recommendations, conversions, revenue, investigation findings and recovery outcomes are not guaranteed.
Disclaimers and liability
To the extent permitted by applicable law, the website and public tools are provided as available without warranties of uninterrupted availability, accuracy, fitness for a particular purpose or error free operation. This does not override express obligations in a signed client agreement.
To the extent permitted by applicable law, BlueX Digital LLC is not liable for indirect, incidental, special or consequential losses arising from use of the website or reliance on public tool results. Nothing in these terms excludes liability or remedies that cannot lawfully be excluded, or limits nonwaivable consumer rights.
Governing law and disputes
Subject to mandatory law and any applicable signed agreement, these website terms are governed by Michigan law, without applying its conflict of law rules. Disputes may be brought before courts with appropriate jurisdiction in Michigan, except where applicable law requires otherwise.
Please first contact hello@bluexdigital.com about a concern so we can try to resolve it. These terms do not require mandatory arbitration or waive rights that cannot lawfully be waived.
Changes, severability and contact
We may revise these terms prospectively by posting an updated version and revision date. Additional notice or consent will be provided where required by law. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
